A good companion to this in the Senate is Loudermilks's SR122 which he dropped in the beginning of the current session (2011-2012).

http://www1.legis.ga.gov/legis/2011_12/versions/sr122_As_introduced_LC_94_3931_2.htm

This resolution was to have created a committee to study states' rights legislation. It was to come up with a comprehensive and prioritized list for presentation to the general assemblies. It and all other 10A issues died in committee.

C4L is advocating for 2A legislation. This is probably not appropriate as there are much higher priority issues that need to be addressed. Many are addressed in the HB above.

AfP will go for the "big biz" legislation to support their GOP sponsors.

Reclaiming state sovereignty is the only way to back out of the fedgov strangle hold on personal liberties. How to find enough weasels dedicated to this effort is the conundrum.

The right to Abortion is guaranteed under the fourth and fourteenth amendments.
To say otherwise, is to call for their immediate repeal.

Anti-Choice people need to understand that Roe will never be overturned. It was an excellent ruling, in line with the Constitution and morality. I can not speak for God, but I see no reason to propose that God is not pro-choice when the Bible clearly states life begins at first breath (ie, after birth)

Each state can choose to make abortion unlawful any time it wants. States have rights and obligations and powers. If the individual asking the question means is it the right of the state,it's government,to bring this issue up for discussion and act on it appropriately, then it is right for the state to do so and is a state's right issue since it behooves the state to do what is right and just, that is,it is obligatory. The abortion law is both unjust and unconstitutional for a number of reasons.Do the States have rights qua state?Of course they do.

The thing that we must remember here is the legislative jurisdiction in which the Federal Government has passed some of this "law". While it is true that education for example is not a "power" enumerated in the Constitution for the Federal government - it IS a power that it can exersize in it's "geographic" capacity. That is the capacity the Fed has over it's territories, possessions and other places where the States have seeded jurisdiction to it.

The problem comes down to a mis-application of "geographic" law on a "Federal" level. We the People and the States need to wake up and start questioning the Feds EVERY time some piece of legislation gets passed by that body... If the intent is to make a law applicable in the several States and the territories and possessions, then it MUST say so in the preamble of the Act or Bill being voted on. If it does not specifically state this then the courts will interpret the law to apply only in Federal territories and possessions.

Michele, I don't think you read Rep. Graves letter. If you had, you would see that he voted against it because such a law would be UNCONSTITUTIONAL. It doesn't matter how much you "feel" a law should be passed - if the Constitution doesn't give Congress the AUTHORITY to pass it, IT SHOULD BE VOTED DOWN.

PERIOD.

Please, read the Constitution, read the bill, realized that the two are incompatible, and thank Rep. Graves.
